Terms and conditions of Bob’s Discount Furniture’s National Nonprofit Day Donation (#NationalNonprofitDay Donation 8/17/2023)
- Please tag a nonprofit in the comments of our post (“Online Submission”). Failure to properly tag or clearly identify the nonprofit’s websitecould result in the intended nonprofit to not be considered. An Online Submission does not guarantee a donation.
- One Online Submission per social media account.
- Bob’s Community Outreach team will review the Online Submissions via social media and solely determine one qualified nonprofit organization to receive the Random Act of Kindness donation check for $2,500.00. Bob’s Discount Furniture reserves the exclusive right to determine the donation based on the Online Submission. An Online Submission is not a guarantee of a donation
- The submission period for nomination will be from the time of the initial post to 11:59 p.m. (eastern standard time) August 18, 2023 (“Submission Period”). No submissions will be considered after the Submission Period.
- Charities must meet the IRS’s definition for a 501(c)(3) organization (Public Charities).
- External sources such as CharityNavigator.org or Guidestar.org may be used to verify an organization’s 501(c)(3) status.
- If your Online Submission of a nonprofit is chosen, you and the nominated nonprofit may be tagged on our social media channels. By submitting an Online Submission you agree, where imposing such condition is legal, that Bob’s and its designees shall have the right, but not the obligation, to the use of your, city and state of residence and/or likeness and Online Submission including any photos (if applicable) for advertising and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission or notification and, upon request, will confirm consent to such use in writing.
- By submitting an Online Submission, you agree to (i.) be bound by these Official Terms and Conditions and the decisions of Bob’s Discount Furniture LLC on all matters relating to the National Nonprofit Day Donation, which are final and binding; and (ii.) release and hold Bob’s Discount Furniture LLC and their respective divisions, affiliates, subsidiaries, officers, directors, employees, agents and representatives (collectively “Releasees”) harmless from any injury, loss or damage to person, including death, personal injury or loss or damage to property due in whole or in part, participation in the National Nonprofit Day Donation. In the event there is a discrepancy or inconsistency between statements contained in any materials and the terms and conditions of these Official Terms and Conditions, these Official Terms and Conditions shall prevail, govern and control. Releasees are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled Online Submission, emails or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the National Nonprofit Day Donation, including, without limitation, errors or difficulties which may occur in connection with the administration of the National Nonprofit Day Donation, the processing of Online Submissions, the announcement of the National Nonprofit Day Donation. Releasees are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Online Submission. Releasees are not responsible for injury or damage to entrants’ or any other person’s computer, or mobile or other device related to or resulting from participating in this National Nonprofit Day Donation, Online Submission or downloading materials from or use of a nominated website. In the event Bob’s Discount Furniture LLC is prevented from continuing with this National Nonprofit Day Donation, or the integrity and/or feasibility of the National Nonprofit Day Donation as planned is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction (each a “Force Majeure” event or occurrence), Bob’s Discount Furniture LLC shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the National Nonprofit Day Donation and, if terminated, award the donation from among all eligible Online Submission received up to that date or as otherwise deemed fair and appropriate by Bob’s Discount Furniture LLC.
- All disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this National Nonprofit Day Donation, the meaning or interpretation of the rules or any prize awarded shall be resolved by applying the laws of the Commonwealth of Massachusetts, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state. All Claims shall be resolved individually, without resort to any form of class action and all Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event include attorneys’ fees, and under no circumstances will any entrant or nonprofit be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and waives all rights to have damages multiplied or otherwise increased.
- The chosen nonprofit may be required to sign a gift agreement with Bob’s Discount Furniture, LLC to receive the donation. The nonprofit will be responsible for all required reporting as required by law.
- Bob’s will announce the nonprofit recipient once the nonprofit recipient has been contacted by the Bob’s Community Outreach team and accepts the donation. Once accepted Bob’s will announce publicly the nonprofit recipient on the original social media post in the comments prior to September 30, 2023.
